Terms and Conditions

for Destinations By Dani Curated Group Getaways

There are two ways to join a Destinations By Dani Curated Group Getaway:

  1. Registration Form: Complete a registration form confirming your intent to travel. An invoice will immediately follow.

  2. Private Booking Site: Complete your reservation directly via a private booking site. All required information, including deposit payment, must be provided at the time of booking.

Additional terms and conditions may be imposed by travel suppliers and/or in-destination authorities. The full terms and conditions set forth herein apply to all Destinations By Dani Curated Group Getaways, in addition to such supplier or authority regulations, except where otherwise noted.

  • Deposits and Payments: All deposits and payments are non-refundable. Payments are due monthly. Depending on the date of your registration and deposit, your payment schedule may be adjusted to meet the trip’s required deadlines.

  • Travel Protection (Required): Travel protection/trip insurance is required for all getaways. Proof of valid coverage must be submitted to Destinations By Dani no later than 90 days prior to travel in order to receive final travel documents.

  • Registration Requirement: Each individual participant must register, even if sharing a reservation with a spouse, partner, or other traveler. During registration, you will be asked to provide the name of the person with whom you are sharing a reservation.

Pricing and Payments

All pricing is subject to change until confirmed by the travel supplier (airline, resort/hotel, cruise line, etc.). Prices may vary due to supplier rate adjustments, currency fluctuations, or other factors outside the control of Destinations By Dani.

Destinations By Dani accepts payments in U.S. Dollars via major debit or credit cards (Mastercard, Visa, Discover, and American Express). The payment card must be in the client’s name unless prior written authorization is provided. By submitting payment, you authorize Destinations By Dani and its travel supplier(s) to charge the approved amount to your payment method.

Payment Plans: Monthly payment plans may be available for certain trips. Payment plans are not offered for bookings made within sixty (60) days of scheduled travel; such bookings must be paid in full at the time of reservation.

Final Payment: All reservations must be paid in full on or before the final payment date stated on your travel invoice. It is your responsibility to ensure timely payments. Reservations not paid in full by the final payment date are subject to automatic cancellation by the travel supplier, without notice. In such cases, all payments made are non-refundable, and you will remain subject to Destinations By Dani’s cancellation policies as well as supplier-imposed penalties and fees.

Credit Card Authorization
By providing a credit or debit card for payment, clients authorize Destinations By Dani and its travel suppliers to charge the approved amounts for deposits, scheduled payments, final balances, cancellation fees, change fees, service fees, and any other amounts expressly stated in these Terms & Conditions or related invoices.

Clients guarantee that they are the legal cardholder or authorized user of the card provided. Payments may be processed directly by Destinations By Dani or charged by travel suppliers on the client’s behalf.

Clients agree not to dispute or chargeback any authorized charges for any reason other than fraud by Destinations By Dani. If a chargeback is initiated, clients remain responsible for all associated costs and fees as outlined in the Chargeback section of these Terms & Conditions.

Clients further acknowledge that debit cards may carry daily charge limits and that multiple charges may be required to complete payments. Clients are responsible for contacting their bank to avoid payment delays that could result in missed deposit or final payment deadlines. Destinations By Dani is not liable for defaults, fees, penalties, pricing issues, or cancellations caused by debit/credit card issues, including but not limited to charge limits, daily limits, or errors in payment processing.

Travel Risks & Responsibilities

All participants must be at least 18 years of age and of sound mind to enter into this Agreement.

Destinations By Dani is not the source or supplier of the travel services requested and acts solely as an agent for the actual suppliers of such services. By booking, participants consent to and request the use of those suppliers and agree not to hold Destinations By Dani responsible should any of these suppliers: (1) fail to provide the travel services purchased; (2) fail to comply with any applicable law; or (3) engage in any negligent act or omission that causes injury, damage, delay, or inconvenience.

Suppliers have their own terms and conditions, which apply in addition to these terms when travel is booked. Destinations By Dani is not responsible for, and shall not be held liable for, any injury, damage, or loss arising from conditions, actions, or omissions beyond its reasonable control.

Travel to many parts of the world may involve health and safety risks, including but not limited to disease, crime, terrorism, and warfare. Each traveler must assess their own risk tolerance. For objective guidance, travelers should consult third-party resources such as the U.S. Department of State (travel.state.gov).

The Transportation Security Administration (TSA) requires government-issued identification to board flights. The name, date of birth, and gender on the identification must exactly match the ticket and booking record. Failure to comply may result in denied boarding or delays. Beginning May 7, 2025, travelers must present a Real ID-compliant license or other accepted identification (see www.dhs.gov/real-id).

Airline tickets, tours, or other travel products may be subject to supplemental price increases after purchase, including increases for fuel surcharges, taxes, or currency fluctuations. Travelers consent to post-purchase price increases and authorize Destinations By Dani to charge their payment method for such amounts if applicable.

Discounted fares typically involve restrictions, and changes may result in supplier-imposed fees.

It is the traveler’s responsibility to ensure they are legally permitted to enter their destination country. For example, travelers with DUI/DWI convictions may be prohibited from traveling to Canada. Some suppliers may not permit travel for pregnant individuals, even with a healthcare provider’s authorization.

Travel Parties: By making any payments toward a reservation, travelers agree to be responsible for the full cost of the services booked. If a travel companion cancels, fails to travel, or leaves mid-trip, the remaining traveler(s) are still responsible for the full cost of the reservation. Some services must be purchased by all individuals sharing accommodations; the full cost will remain due regardless of participation.

Travel Protection/Trip Insurance: Travel protection/trip insurance is required for all Destinations By Dani Curated Group Getaways. Proof of valid coverage must be provided to Destinations By Dani no later than 90 days prior to travel in order to receive final travel documents.

At a minimum, insurance must include coverage for trip cancellation, trip interruption, delays, medical emergencies, evacuation, and lost or delayed baggage. Travelers are strongly encouraged to select a policy that includes Cancel For Any Reason (CFAR) coverage, if available in their state of residence. Please note: CFAR protection is not available in every state.

By booking a Curated Group Getaway, you acknowledge that all deposits and payments are non-refundable and non-transferable, and that without adequate insurance, you may have no recourse for recovering lost funds should you cancel or experience a covered event.

Destinations By Dani is not a travel insurance provider or broker. Insurance options may be presented for your consideration, but you are under no obligation to purchase through a specific supplier. All coverage questions must be directed to the insurance provider.

Reservation Change Requests

All change requests must be submitted in writing to Danielle@DestinationsByDani.com with the subject line “Change Request” and/or submitted via a Change/Cancellation Request form.

A change fee of $50 per incident (for the first traveler) will apply for modifications made to your confirmed booking. If additional travelers on the same booking request the same change at the same time, an additional $25 per traveler will apply. These fees are in addition to any charges imposed by the travel supplier(s).

Change fees will be invoiced and must be paid prior to processing the requested change. Requested changes will not be completed until payment is received.

Please note that certain changes may require cancellation and rebooking per the policies of the travel supplier(s). You may be responsible for any difference in price at the time of your request, and previously booked elements may no longer be available. Destinations By Dani has no control over price or availability.

Cancellation Requests

All cancellation requests must be submitted in writing to Danielle@DestinationsByDani.com with the subject line “Cancellation Request” and/or submitted via a Change/Cancellation Request form.

A cancellation fee of $100 per booking will be assessed for cancellations initiated by the client. This fee is in addition to any penalties or fees charged by the travel supplier(s). The Destinations By Dani cancellation fee is non-refundable and will be automatically charged to the payment method used for the final or most recent payment. If that payment method is declined, you remain responsible for remitting payment by another method within 30 days of invoice. Travel arrangements will not be canceled until the fee is received.

The cancellation fee also applies in cases of payment default, including missed or declined payments that result in automatic cancellation of the reservation by the travel supplier.

Destinations By Dani does not issue refunds, credits, or transfers for any portion of a Curated Group Getaway, regardless of supplier or third-party policies.

In the rare event that a trip is canceled by Destinations By Dani or by the travel supplier(s), any refund or credit issued will be subject solely to the supplier’s policies and procedures. Refunds may be issued in the form of cash, travel credit, or a future travel voucher at the supplier’s discretion. Destinations By Dani has no control over the timing, amount, or method of such refunds.

Clients agree not to initiate a credit-card chargeback or payment dispute, as this may cause further delay or forfeiture of any eligible supplier refund or credit.

Chargebacks

Trip payments are a binding agreement in which you authorize Destinations By Dani to charge your credit card for the approved amount. By entering into this agreement, you and all members of your travel party waive the right to initiate a chargeback for any reason other than fraud. This includes, but is not limited to, force majeure events, supplier cancellations, or voluntary cancellation for any reason.

Refunds of travel payments are subject to the terms and policies of the travel supplier(s), including timing and method of refund (cash or credit). Attempting to recover payments through a chargeback may cause delays in receiving any eligible refund.

If you initiate a chargeback without valid cause, Destinations By Dani reserves the right to:

  • Assess a $100 administrative fee to cover the process of providing documentation to the credit card company.

  • Invoice you for all costs associated with the recovery of funds, including attorney fees and court costs, if applicable.

Chargeback-related fees will be invoiced and are due within 30 days of issue. If unpaid, Destinations By Dani reserves the right to charge the balance to the payment method used for your final or most recent payment.

The provisions of this section survive termination of this Agreement.

Late Payments / Defaults

If a payment is missed, declined, or otherwise not received by the stated due date, Destinations By Dani reserves the right to assess a late payment fee of $25 per occurrence.

If full payment is not received within the supplier’s required timeframe, the booking may be canceled by the supplier and subject to the $100 cancellation fee outlined above.

Late fees will be invoiced and due within 30 days of issue. If unpaid, Destinations By Dani reserves the right to charge the balance to the payment method used for your final or most recent payment.

Collections and Small Claims Court

Clients remain responsible for all fees and costs outlined in this Agreement. Any outstanding balance not paid within 30 days of invoice may be referred to small claims court or a collections agency at the discretion of Destinations By Dani. All proceedings will be filed in the jurisdiction where Destinations By Dani is based. Clients will be liable for all associated costs, including, but not limited to, filing fees, attorney’s fees, and court costs.

Government & Supplier Regulations

All travelers are responsible for complying with all laws, regulations, requirements, and policies of government authorities, airlines, cruise lines, tour operators, resorts, and other suppliers involved in their travel. This includes (but is not limited to) requirements related to identification, passports, visas, entry forms, vaccinations, health protocols, customs, taxes, security screenings, and codes of conduct.

Destinations By Dani is not responsible for denied boarding, denied entry, delays, cancellations, missed portions of a trip, or additional expenses incurred due to a traveler’s failure to comply with such requirements. Refunds or remedies, if any, will be subject to the policies of the travel supplier(s).

Special Clauses

Financial Abandonment Clause
If, within sixty (60) days of deposit authorization, no subsequent payment has been received, the reservation may be considered inactive. The client may receive an “Intent to Cancel” notification. If the client does not respond or provide payment authorization within the specified period, the reservation will be considered abandoned and subject to the cancellation terms of this Agreement, including the $100 cancellation fee per booking and any applicable supplier penalties.

Hostility Clause
Destinations By Dani reserves the right to terminate this Agreement with any client who becomes hostile to the point that services cannot reasonably be completed. Offensive language, threats, repeated disregard of boundaries (including availability and working hours), or abusive behavior of any kind will not be tolerated. If this clause is invoked, Destinations By Dani may release the reservation from management. Cancellation may occur, and all related penalties will apply. Monies already paid may be forfeited or applied to a new booking at the sole discretion of the supplier.

Group Harmony Clause
During Destinations By Dani Curated Group Getaways, tardiness, disruptive conduct, or combative behavior will not be tolerated. Such behavior is grounds for dismissal from the group trip and permanent exclusion from future Group Getaways. Monies already paid may be forfeited.

Health & Safety / Force Majeure Clause
Travel may be interrupted, delayed, or canceled due to events beyond the control of Destinations By Dani, including but not limited to pandemics, epidemics, public health emergencies, severe weather, natural disasters, acts of terrorism, labor disputes, supplier defaults, or government restrictions.

By booking, the client acknowledges that travel carries inherent risks, including exposure to communicable diseases such as COVID-19, influenza, or other viruses, which may result in illness, injury, disability, or death. The client voluntarily assumes all such risks and agrees to hold Destinations By Dani harmless from any liability for illness, injury, losses, or expenses resulting from these events.

The client further acknowledges that certain amenities, services, or activities may be unavailable, altered, or canceled at any time by suppliers, government authorities, or third parties beyond the control of Destinations By Dani. Refunds, rebooking, or credits in such circumstances will be subject solely to the policies of the travel supplier(s).

Because travel protection/trip insurance is required for all Destinations By Dani Curated Group Getaways, clients are expected to seek recourse through their insurance provider for covered events. Insurance claims must be filed directly with the insurance provider in accordance with the terms of the policy purchased.

Client Responsibilities

Clients are responsible for reading and responding to correspondence, and for providing, in a timely manner, any information or documents necessary for Destinations By Dani to satisfy travel requirements on their behalf.

Clients must review and update any identification, contact, and safety information as requested, and notify Destinations By Dani immediately if any such information changes during the planning process.

Clients are responsible for verifying the details of their trip, including (but not limited to) personal identification, contact and emergency contact information, and travel document validity and expiration dates, prior to booking and at any time requested by Destinations By Dani during the management of their travel.

Clients must carefully review all travel documents for accuracy upon receipt and contact Destinations By Dani with any questions or concerns related to their arrangements or these Terms and Conditions.

Clients must provide proof of valid travel protection/trip insurance no later than 90 days prior to travel in order to receive final travel documents.

Governing Law & Miscellaneous

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

This Agreement constitutes the entire understanding between the client and Destinations By Dani with respect to the subject matter herein and supersedes all prior or contemporaneous communications, whether electronic, oral, or written. No modification of this Agreement shall be effective unless in writing and signed by both parties.

Knowing and Voluntary Execution

By booking a Destinations By Dani Curated Group Getaway, clients acknowledge that they have carefully read these Terms and Conditions, including cancellation policies and penalties, and fully understand their contents. Clients further acknowledge that this Agreement contains releases of liability and constitutes a legally valid and binding agreement between the client and Destinations By Dani, on behalf of themselves and each member of their travel party.
