The Agent-Client Agreement

Travel Risks & Responsibilities

​

All clients must be at least 18 years of age and of sound mind to enter this Agreement.

​

Destinations By Dani (“DBD”) is not the source or supplier of the travel services requested and acts solely as an agent for independent suppliers (airlines, cruise lines, hotels, resorts, tour operators, transportation providers, etc.). By booking, clients consent to the use of those suppliers and agree not to hold DBD responsible if a supplier: (1) fails to provide purchased services; (2) fails to comply with applicable law; or (3) engages in any negligent act or omission causing injury, damage, delay, or inconvenience.

Suppliers maintain their own terms and conditions which apply in addition to these Terms when travel is booked. DBD is not responsible for injury, damage, or loss arising from conditions, actions, or omissions beyond its reasonable control.

​

Travel may involve health and safety risks, including but not limited to disease, crime, terrorism, and warfare. Each traveler must determine their own risk tolerance. For objective guidance, consult third-party resources such as the U.S. Department of State (travel.state.gov).

​

Identification & REAL ID: TSA requires government-issued identification to board flights. The name, date of birth, and gender on the ID must exactly match the ticket and booking record. Failure to comply may result in denied boarding or delays. Beginning May 7, 2025, travelers must present a REAL ID-compliant license or other accepted identification (see dhs.gov/real-id).

Post-Purchase Price Increases: Airline tickets, tours, and other travel products may be subject to supplemental price increases after purchase (e.g., fuel surcharges, taxes, currency fluctuations). Clients consent to such increases and authorize DBD to charge the approved payment method for any applicable additional amounts.

​

Restricted/Discounted Fares: Discounted or restricted fares may carry change limitations or penalties.

​

Entry Eligibility: Clients are solely responsible for ensuring they are legally permitted to enter the destination country (e.g., travelers with certain criminal convictions may be denied entry to Canada). Some suppliers restrict travel for pregnant individuals even with a physician’s note.

​

Travel Parties: By making any payment toward a reservation, each traveler agrees to be responsible for the full cost of the services booked. If a roommate/companion cancels, fails to travel, or departs mid-trip, remaining traveler(s) are responsible for the full reservation cost. Some services must be purchased for all occupants of a shared room; the full cost remains due regardless of participation.

Travel Protection / Trip Insurance

Travel insurance is strongly advised for all trips to help cover risks such as supplier default, medical emergencies, and inability to travel due to illness or personal events. Travelers who decline insurance assume full responsibility for penalties, losses, and out-of-pocket expenses (including but not limited to cancellation costs, medical emergencies, supplier defaults, or delays).


If insurance is declined at booking, a signed waiver is required before DBD releases travel documents. Insurance purchased later may exclude certain benefits (e.g., pre-existing condition waivers). DBD is not an insurance provider or broker and cannot advise on coverage. All insurance questions should be directed to the insurer.

 

 

Pricing & Payments

​

Quoted prices reflect live rates at the time of proposal and are subject to change until a reservation is finalized by application of an authorized deposit.

​

DBD accepts payment in U.S. Dollars via major credit/debit cards (Mastercard, Visa, Discover, American Express). The payment card must be in the client’s name unless prior written authorization is provided. By submitting payment, clients authorize DBD and travel suppliers to charge the approved amounts on invoices, including deposits, scheduled payments, and final balances.

Deposits & Ongoing Payments: A deposit is due at booking to secure a reservation. Clients are responsible for authorizing subsequent payments to keep reservations current through the final payment due date shown on the invoice.

​

Payment Plans: Monthly payment plans may be available if requested more than sixty (60) days prior to travel. Requests made sixty (60) days or fewer before travel may require payment in full at booking.

​

Final Payment: All reservations must be paid in full by the invoice due date. Reservations not paid in full by the due date are subject to automatic supplier cancellation without notice. All monies paid may be non-refundable, and supplier penalties/DBD policies will apply.

​

Credit Card Authorization
By providing a credit or debit card for payment, clients authorize Destinations By Dani and its travel suppliers to charge the approved amounts for deposits, scheduled payments, final balances, cancellation fees, change fees, service fees, and any other amounts expressly stated in these Terms & Conditions or related invoices.

​

Clients guarantee that they are the legal cardholder or authorized user of the card provided. Payments may be processed directly by Destinations By Dani or charged by travel suppliers on the client’s behalf.

​

Refunds, rebookings, cancellations, surcharges, and other payment-related policies are governed by supplier terms and conditions, which may include additional fees and restrictions outside of Destinations By Dani’s control.

​

Clients agree not to dispute or chargeback any authorized charges for any reason other than fraud by Destinations By Dani. If a chargeback is initiated, clients remain responsible for all associated costs and fees as outlined in the Chargeback section of these Terms & Conditions.

​

Clients further acknowledge that debit cards may carry daily charge limits and that multiple charges may be required to complete payments. Clients are responsible for contacting their bank to avoid payment delays that could result in missed deposit or final payment deadlines. Destinations By Dani is not liable for defaults, fees, penalties, pricing issues, or cancellations caused by debit/credit card issues, including but not limited to charge limits, daily limits, or errors in payment processing.

 

 

Reservation Change Requests

​

All change requests must be submitted in writing to Danielle@DestinationsByDani.com with the subject line “Change Request.”

​

A DBD change fee of $50 per incident (for the first traveler) applies to modifications to a confirmed booking. If additional travelers on the same booking request the same change at the same time, an additional $25 per traveler applies. These fees are in addition to any supplier penalties/fees.


Change fees are invoiced and must be paid prior to processing. Certain changes may require cancellation and rebooking under supplier terms; price differences may apply and previously booked elements may no longer be available. DBD does not control supplier pricing or availability.

 

 

Cancellation Requests

​

All cancellations must be submitted in writing to Danielle@DestinationsByDani.com with the subject line “Cancellation Request.”

​

A DBD cancellation fee of $100 per booking applies to client-initiated cancellations (in addition to supplier penalties). The fee is non-refundable and will be automatically charged to the payment method used for the final or most recent payment. If declined, the balance is due within 30 days of invoice. Travel will not be canceled until the cancellation fee is received. This fee also applies in cases of payment default (missed or declined payments) that result in supplier cancellation.

​

Refunds or credits, if any, are governed solely by supplier policies (including timing and form—cash vs. credit). Initiating a credit card chargeback may delay or jeopardize any supplier refund/credit.

 

 

Chargebacks

​

Trip payments are a binding authorization to charge the approved amount. By entering this Agreement, clients (for themselves and their travel party) waive the right to initiate a chargeback except in cases of fraud.

​

If a chargeback is initiated without valid cause, DBD may:

  • Assess a $100 administrative fee to cover documentation and response; and

  • Invoice all costs of recovery (including attorney’s fees and court costs).
     

Chargeback-related fees are due within 30 days of invoice; if unpaid, DBD may charge the card used for the most recent payment. This section survives termination of the Agreement.

 

 

Late Payments / Defaults

​

A $25 late fee applies per missed or declined payment. If the supplier cancels for non-payment, the $100 DBD cancellation fee also applies.

 

 

Collections & Small Claims Court

​

Any balance not paid within 30 days of invoice may be referred to small claims court or a collections agency at DBD’s discretion. Proceedings will be filed in New York, where DBD is based. Clients are liable for associated costs, including filing fees, attorney’s fees, and court costs.

 

 

Government & Supplier Regulations

​

Clients are responsible for complying with all laws, regulations, requirements, and policies of government authorities and travel suppliers (airlines, cruise lines, tour operators, resorts/hotels, transportation providers). This includes, but is not limited to, identification, passports, visas, entry forms, vaccinations/health protocols, customs, taxes, security screenings, and codes of conduct.

​

DBD is not responsible for denied boarding/entry, delays, cancellations, missed trip components, or added costs due to non-compliance. Remedies, if any, are subject to supplier policies.

 

 

Special Clauses

​

Financial Abandonment Clause
If no subsequent payment is received within sixty (60) days of deposit authorization, the reservation may be deemed inactive. An “Intent to Cancel” notice may be sent. If the client does not respond or provide payment within the specified period, the reservation will be considered abandoned and subject to this Agreement’s cancellation terms, including the $100 cancellation fee per booking and applicable supplier penalties.

​

Hostility Clause
DBD may terminate this Agreement if a client’s conduct prevents services from being reasonably completed. Offensive language, threats, repeated boundary violations (including availability/working hours), or abusive behavior are not tolerated. If invoked, DBD may release the reservation from management; cancellation may occur and penalties will apply. Monies paid may be forfeited or applied per supplier discretion.

 

Health & Safety / Force Majeure Clause
Travel may be interrupted, delayed, or canceled due to events beyond DBD’s control, including but not limited to pandemics/epidemics, public health emergencies, severe weather, natural disasters, acts of terrorism, labor disputes, supplier defaults, or government restrictions.


By booking, clients acknowledge inherent travel risks—including exposure to communicable diseases such as COVID-19 or influenza—and agree to hold DBD harmless from illness, injury, losses, or expenses resulting from such events. Amenities/services may be unavailable, altered, or canceled by suppliers or authorities. Refunds/credits/rebookings are governed solely by supplier policies. Travel insurance is strongly advised; coverage depends on the policy purchased. Clients who decline insurance assume all financial risk.

 

 

Travel Design Requests (Service Scope & Fees)

​

Service Scope: DBD will research, design, and manage personalized travel experiences, including up to 3 proposals per trip request. Proposals may include: airfare (if requested), accommodations, airport transfers, optional excursions, upgrades, insurance options, and payment plan structures.

​

If travel is booked, clients receive access to the Trip Plans itinerary app (digital documents, real-time updates, in-app messaging), plus printed copies of documents upon request 2–4 weeks prior to travel.

​

Research & Design Fee:

  • Covers research, design, planning, and management.

  • Due immediately to begin service; valid for 45 days from receipt.

  • Non-refundable and non-transferable.

  • Starting at $100 per trip request (see structure below).
     

Fee Structure:

  • 1–4 rooms: $100 per trip request

  • 5–10 rooms: $200 per trip request

  • 10–15 rooms: $250 per trip request

  • 15+ rooms: $300 per trip request
     

For Group Travel Design Requests (5+ rooms):

  • A one-time group management fee of $50 per traveler (age 2+) applies at booking.

  • The lead guest submitting the request is exempt.

  • This fee is non-refundable and non-transferable.
     

 

 

Flight-Only Requests & Group Air Bookings

​

Destinations By Dani (“DBD”) accepts flight-only booking requests on a limited basis as a professional courtesy. Because airlines do not compensate travel advisors or work directly with agencies, all flight-only services are subject to a non-refundable professional service fee separate from the cost of airfare. This fee covers the time, coordination, and administrative management involved in securing, confirming, and communicating flight arrangements for individuals or groups.

​

Service Scope

  • Applies to one-way, round-trip, or same-day round-trip itineraries not attached to a full travel package.

  • For groups of 10 or more travelers, reservations may be processed as large-party bookings or formal group bookings depending on airline policy and fare rules.

  • DBD will confirm the applicable service fee before any flight coordination begins.

  • DBD provides one (1) flight itinerary and fare quote per request. Additional quotes or itinerary changes may incur additional fees.

 

Client Responsibilities

  • Passenger names must match passports or government-issued identification exactly. Incorrect or incomplete information may result in ticket reissue fees or forfeiture.

  • Clients are responsible for providing accurate traveler details and verifying all information before ticket issuance.

  • For group requests, the lead traveler may:

    • Have DBD collect traveler information directly, or

    • Gather and submit all details using a DBD-provided spreadsheet.

  • Clients must notify DBD of any travelers requiring wheelchair assistance or other accessibility accommodations prior to booking.

  • Seat assignments, special meals, and other preferences are not guaranteed and remain subject to airline availability and change without notice.

 

Payment

  • Full payment is required before ticketing. Fares and availability are not guaranteed until payment is processed.

  • Payment may be submitted individually by each traveler or collectively by the group lead. In the latter case, DBD will issue a single invoice for the total amount due.

 

Limitations

  • Once tickets are issued, all changes, cancellations, and refunds are governed solely by the airline’s fare rules and policies.

  • DBD acts solely as an intermediary and cannot control flight delays, cancellations, or schedule changes. Clients must work directly with the airline for any post-ticketing modifications or disruptions.

 

Group vs. Large-Party Flight Bookings

Airlines define “group bookings” differently, but most require a minimum of 10 passengers traveling together on the same flights and dates to qualify. For this reason, DBD will determine whether a request is best processed as a formal group booking or a large-party booking of individually ticketed travelers.

​

Group bookings may allow for seat holds without immediate payment, name changes prior to ticketing, and consolidated fare quotes; however, they often include stricter payment terms and higher per-ticket pricing.

​

Large-party bookings are managed through standard airline systems and generally offer greater flexibility and access to competitive published fares.

​

DBD will recommend the most advantageous option based on the airline’s policies, fare rules, travel dates, and overall group needs. Regardless of booking method, all tickets are governed by the respective airline’s rules and conditions once issued.

 

 

Client Responsibilities

​

  • Clients must read and respond to correspondence and provide, in a timely manner, any information or documents necessary for DBD to satisfy travel requirements.
     

  • Clients must review/update identification, contact, and safety information as requested and promptly notify DBD of changes.
     

  • Clients are responsible for verifying trip details (identity data, emergency contacts, document validity/expiration) prior to booking and whenever requested by DBD.
     

  • Clients must review all travel documents for accuracy upon receipt and contact DBD with any questions or concerns regarding arrangements or these Terms.

 

 

Governing Law

​

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law principles.

 

 

Knowing & Voluntary Execution

​

By booking with Destinations By Dani, clients acknowledge that they have carefully read, fully understand, and agree to be bound by these Terms & Conditions, including cancellation policies and penalties. Clients are aware that this Agreement contains releases of liability and constitutes a legally valid and binding agreement between themselves (and each member of their travel party) and Destinations By Dani, entered into of their own free will.
